Constitutional Rights

Montana’s Constitution includes a clause about an individual’s right to privacy. Section 10 within the declaration of rights says, “The right of individual privacy is essential to the well-being of a free society and shall not be infringed without the showing of a compelling state interest.”

The framers of the Constitution wanted to preserve Montanan’s privacy. They wanted to protect people’s information.

Subsequent legislators have introduced legislation to continue this practice of giving people privacy. This covers healthcare, education, and unnecessary intrusion by the government into people’s lives.
